Position Summary:
The City Attorney performs complex executive and professional level work as legal advisor to the Mayor and Common Council, City Administrator, City staff and duly constituted boards, committees, and commissions of the City; and to conduct all of the legal business in which the City has an interest. The City Attorney drafts ordinances and resolutions, prosecutes ordinance violations, and commences other legal actions for collection and condemnation. The City Attorney performs duties in personnel matters such as legalities regarding discipline, hiring, firing and suspension of employees, as well as participating on the City union contract negotiating team. This position requires a highly experienced executive level attorney who can provide expert assistance and solid legal advice. This position possesses considerable discretion in fulfilling its duties and responsibilities.
Principal Duties and Responsibilities:
1. Render oral and written legal opinions to the Mayor and Council, City Administrator, and Department Heads, and other City staff as requested;
2. Represents the City in civil litigation, administrative proceedings before state and federal agencies, and labor arbitration hearings.
3. Research, drafts and presents legal papers necessary for prosecution or defense of litigation involving the City;
4. Research, interpret, and apply laws, court decisions, and other legal authority in the preparation of opinions and briefs.
5. Attend Monthly Regular Common Council and Special Common Council and Committee of the Whole meetings as called, and renders legal advice on matters on the agenda;
6. Attend as an ex-officio member of the Board of Public Works, City Plan Commission; and staff to the Personnel & Finance Committee (along with the City Administrator, City Clerk and Finance Director), and CATV Committee, and render legal advice on matters on the agenda
7. Attend other Committee, Commission and Board meetings as requested, and render legal advice on matters on the agenda;
8. Respond to inquiries from the public relative to municipal ordinances and legal matters affecting the City;
9. Draft all legislation considered by the Common Council;
10. Prepare ordinances, resolutions, contracts, deeds, leases, legal opinions, and other legal documents.
11. Prosecute ordinance violations for the City of Merrill, and contractually for the City of Tomahawk;
12. Draft policies and procedures as requested;
13. Provide verbal legal advice to City Officials and Department Heads on a daily basis;
14. Perform statutory duties as per Wisconsin State Statutes 62.09(12) relating to City Attorneys;
15. Work with Planning and Zoning Departments in formulating long range plans for the City.
Additional Duties and Responsibilities:
1. Maintain membership in the Wisconsin State Bar and Lincoln County Bar Associations;
2. Other duties as may be necessary to fulfill the responsibilities of this position.

Work very closely with employees in the same and other departments, and general public. Has occasional contact with vendors, community, and regulatory agencies. Has access to highly confidential information.
Knowledge, Skills and Abilities, Qualifications Required:
Graduation from a school of law accredited by the American Bar Association with a Juris Doctor degree and extensive, at least five (5) years, experience practicing law, including trial experience, managerial or supervisory experience and some government agency experience Incumbent must possess a license to practice law in the State of Wisconsin, and retain same while employed by the City.
· Thorough knowledge of the principals and practices of civil law, municipal and labor law;
· Thorough knowledge of the principal methods, materials, and practices of legal research and investigations;
· Considerable knowledge of local ordinance and of state and federal laws and constitutional provisions affecting municipal operations;
· Ability to analyze legal documents and instruments;
· Ability to negotiate agreements, which accommodate conflicting interests and viewpoints.
· Ability to appraise and organize facts and to present evidence and other material in effective written or oral form;
· Ability to establish and maintain effective relationships with City officials, County officials, City employees and the general public;
· Ability to get along well with others, and show tact and courtesy;
· Ability to work under significant pressure;
· Possess good judgment, thoroughness, and dependability;
· Ability to attend meetings and perform work assignments at times other than normal business hours.
· Ability to produce desired work outcomes including quality, quantity and timeliness.
Candidates are required to pass physical examination once job is offered. Physical examination is paid for by the City. Until physical examination has been conducted and records turned over to the City of Merrill, applicant chosen is not officially hired.
Working Conditions:
: Work is performed largely in an office environment with minimal chance for personal injury. Work hours are generally during regular business hours, may be subject to call depending on the City’s needs. Attendance at Common Council, board committee and commission meetings is required outside of regular work hours. Incumbent may be required to travel out of town for education and professional development as well as for other matters relating to City business.
: Requires sitting extensively, walking, standing and talking. Requires normal vision and use of keyboard and telephone.

Job Type: Full-time
Pay: $102,003.00 – $131,435.00 per year
