Job Overview

Workers’ Compensation Board – Lewiston. Grade 27 / Professional Technical. Salary $58,219.20 – $81,806.41 annually
. Position number . This position provides professional advocacy and legal services to injured workers.

Telework:
Partial/Hybrid after the probationary period, with all telework performed in the State of Maine. This position is not eligible for visa sponsorship or STEM OPT extensions.

Key Responsibilities

  • Represent injured workers in administrative hearings and other proceedings to provide legal services and representation.
  • Analyze case information, document facts, and prepare reports to advocate for injured workers.
  • Counsel and advise injured workers to protect their legal rights.
  • Explain laws, legal rights, options, timelines, and risks to ensure workers are knowledgeable of their rights.
  • Negotiate and confer with insurance adjusters, private attorneys, employers, health care providers, and other third parties to protect workers’ rights.
  • Write legal memoranda and briefs for litigation and administrative proceedings.
  • Explain Workers’ Compensation Board decisions, rules, and procedures to injured workers.
  • Determine the scope of investigation on claims to ensure comprehensive services in an efficient timeframe.
  • Negotiate resolutions or compromises to reduce litigation claims.
  • Assist injured workers in obtaining rehabilitation, return‑to‑work, and employment security services.
  • Take depositions of treating and examining physicians and other involved parties.
  • Prepare cases for appellate review to the Law Court.
  • Review and draft findings in mediation or administrative hearings.
  • Coordinate legal services with senior legal staff for consistent interpretation of the law.

Knowledge, Skills, and Abilities

  • Knowledge of state and federal laws, administrative laws, and case law affecting Workers’ Compensation Board programs.
  • Knowledge of basic legal concepts of due process, administrative law, constitutional law, torts, and contracts.
  • Knowledge of legal documents, court procedures, and rules of evidence.
  • Knowledge of medical and legal terminology and practices in workers’ compensation.
  • Knowledge of legal research and trial techniques.
  • Knowledge of interviewing and investigative techniques.
  • Ability to research, analyze, and organize legal facts and principles.
  • Ability to communicate and write effectively.
  • Ability to establish and maintain effective working relationships.
  • Ability to negotiate mediation agreements, lump‑sum settlements, or other voluntary resolutions.
  • Ability to prepare and maintain complex cases and large caseloads.
  • Ability to handle difficult and adversarial situations.
  • Ability to maintain confidentiality of client information and communications.

Minimum Qualifications

Admission to practice law in Maine and current registration with the Maine Bar, or eligibility for admission within twelve (12) months of hire.
