POSITION SUMMARY
The Municipal Prosecutor is responsible for prosecuting violations of municipal ordinances, infractions, and misdemeanors in municipal court. This role involves preparing and presenting cases, advising law enforcement, and ensuring fair and efficient administration of justice at the local level. The Municipal Prosecutor plays a key role in maintaining public safety and upholding the rule of law within the city or town.
Court is held on the first three Mondays of each month (lawyer and citizen dockets). Those dockets require the City Prosecutor to be on duty from 3:00 pm to approximately 8:30 pm on each of those scheduled court dates. In addition, the City Prosecutor comes to City Hall for approximately one hour on the 4th Monday of each month to sign tickets. The City provides the City Prosecutor with a part-time assistant.
Job Responsibilities (Include, but not limited to)
Review police reports, citations, complaints, and other documentation to determine appropriate charges.
Prosecute cases in municipal court, including arraignments, pre-trial conferences, trials, and sentencing hearings.
Negotiate plea agreements in accordance with municipal policies and ethical obligations.
Advise law enforcement officers on legal issues, case preparation, and court procedures.
Represent the municipality in appeals and administrative hearings as needed.
Maintain accurate records and documentation of all proceedings and case outcomes.
Collaborate with court personnel, public defenders, victims, witnesses, and law enforcement to coordinate cases and ensure procedural fairness.
Provide legal training and updates on changes in municipal and criminal law to relevant stakeholders.
Draft legal documents including motions, briefs, and court orders
Attend city council or committee meetings as needed to provide legal input related to municipal prosecution
Minimum Qualifications
Juris Doctor (JD) degree from an accredited law school
Member in good standing of the Missouri Bar for at least three years
At least one-year experience in Missouri as a city prosecutor or assistant prosecutor or experience as a municipal judge
Minimum of 2 years of experience in criminal law, municipal law
Preferred
Court prosecution experience
Physical Demands and Work Environment
Requires the ability to operate a variety of office equipment such as computer, telephone, fax machine, and printer
Requires the ability to coordinate eyes, hands, feet and limbs in performing movements requiring skill and training, such as data entry
Tasks involve the ability to exert light physical effort in sedentary to light work, but which may involve some lifting, carrying, pushing and pulling of objects weighing up to 25 pounds
Tasks will involve extended periods of time at a keyboard or workstation
Requires the ability to recognize and identify individual characteristics of shapes and sounds associated with job-related objects, materials and tasks
Typical office environment and will require evening hours for court sessions or public meetings; frequent interaction with the public, city officials, and legal professionals. May be exposed to highly stressful situations and individuals who are irate or hostile.
Pay & Benefits
This position is compensated at a flat monthly rate, with additional hourly compensation for legal work related to appeals beyond the municipal court level.
