Senior Employment Counsel:
ALO is seeking a mid-to-senior level employment attorney to help build ALO’s employment infrastructure in China. This position requires a strategic lawyer with labor and employment experience gained at a leading law firm and in-house, who is comfortable operating independently in a fast-moving environment with limited existing infrastructure. The role will cover employment contract drafting, employee relations, labor compliance, workforce policies, and ongoing employment law support across all aspects of ALO’s China business.
The position is an in-office role based in Shanghai.
Key Responsibilities:
Employment Infrastructure and Compliance:
- Draft, review, negotiate, and manage a wide range of employment-related agreements to support ALO’s China operations, including individual employment contracts, fixed-term and open-ended labor contracts, confidentiality and non-competition agreements, secondment arrangements, agreements, and separation agreements.
- Adapt ALO’s global employment templates and policies for use in the China market, ensuring compliance with PRC labor law and local employment practices.
- Work closely with HR to ensure all employment agreements are properly executed, tracked, and stored.
- Lead the legal workstream for building ALO’s employment framework in China, including employment policies, workplace rules and regulations, and employment documentation required under PRC labor law.
- Coordinate with external PRC employment counsel, benefits advisors, and labor authorities to ensure full compliance with local employment requirements.
·Employee Relations and Labor Compliance:
- Advise on compliance with PRC labor and employment laws and regulations, including Labor Contract Law, Labor Law, Social Insurance Law, Employment Promotion Law, and applicable local rules and regulations.
- Advise on employee data privacy compliance under the Personal Information Protection Law (PIPL) as it applies to HR data collection, processing, and cross-border transfer of employee personnel information.
- Monitor labor and employment regulatory developments in China that may affect ALO’s workforce practices and proactively advise the business and HR teams on required changes.
Workplace Policies and Investigations:
- Develop and implement workplace policies, including anti-discrimination, anti-harassment, code of conduct, disciplinary procedures, and grievance mechanisms, consistent with PRC law and ALO’s global standards.
- Support internal investigations involving employee misconduct, workplace complaints, and other employment-related disputes, and advise on appropriate disciplinary actions and termination procedures under PRC law.
Qualifications:
- Law degree from a leading university and strong academic credentials
- Qualified to practice law in the PRC; admission to a U.S. state bar or qualification in another common law jurisdiction is a plus
- Five to ten years of relevant labor and employment legal experience, with a meaningful combination of work at a leading international or PRC law firm and in-house at a multinational company operating in China
- Experience drafting employment contracts, HR policies, separation agreements, and other employment-related documentation under PRC law
- Strong knowledge of PRC labor and employment law, including the Labor Contract Law, Labor Law, Social Insurance Law, and local implementing regulations
- Experience advising on employee benefits, social insurance, housing fund contributions, and workforce restructurings in China is a strong plus
- Experience with labor arbitration and employment litigation in China is a plus
- Fluency in Mandarin and English (written and spoken) is required
- · Exceptional organizational skills, attention to detail and a strong work ethic
- · Outstanding analytical and communication skills, both written and verbal
- · Self-starter with ability to balance many projects simultaneously and complete tasks accurately, on schedule and with minimal supervision
- · Willingness to take initiative and work flexible hours to accommodate collaboration with U.S.-based teams
