PURPOSE & OBJECTIVE
Under the supervision of the Contract Superintendent, the Senior Contract Administrator (SCA) participates in implementing and coordinating, throughout the contract life cycle, the resources and processes needed to control the company's operational, financial and contractual risks during the performance of contracts. It thus contributes to improving the operational and financial performance of contracts, by:
- Controlling operational risks (safety and quality deviations, technical non-conformities) and financial risks (additional costs, budget overruns, schedule slippage, margin deterioration, etc.) in close collaboration with the relevant internal operational functions/teams;
- Contributing to optimising expenditure and financial gains;
- Guaranteeing respect for the Group's values and compliance with our regulatory and contractual commitments (responsible purchasing, ethics & compliance and CSR policies);
- Optimising legal litigation strategy (particularly during the pre-litigation phase).
KEY ACCOUNTABILITIES
Dimensions
- Budget: cost of procurement contracts (service provision, intellectual services, works contracts, materials and equipment, and CAPEX investment contracts) in accordance with the annual budget. Staff supervised: Contract administrators and trainees
- Scope: all contracts carried out on site;
- Main interactions:
➢ Interacts closely with the operational and support functions of the entity concerned and of the Group, such as Legal, Purchasing, Operations, Finance, Risk and Compliance – Interacts also externally with Suppliers/Contractors/State entities;
➢ Interacts within the network of Contract Managers.
Complexity factors
The position is complex in the following respects:
- From the upstream phase of the purchasing process and throughout the life cycle of the contract, there is a need for cross-functional coordination between the Contract Management teams and the operational teams, and proactive interaction with the stakeholders to ensure proper monitoring of the operational aspects of the execution of the contract and its environment, and anticipation of contractual risks and opportunities;
- Taking part, under the guidance of the Contract Superintendent, in the multidisciplinary management of all aspects of contracts (organizational, project management, legal, technical, engineering, financial, tax & customs, logistics, safety, CSR, applicable regulations);
- Make proposals to improve contract performance;
- Anticipating the various events (internal or external) that could impact on the proper performance of contracts and proposing effective mitigation measures.
Main aims of the position
- The Senior Contract Administrator is responsible for ensuring the proper management of:
- contract performance, ensuring that contractual and regulatory obligations are met by the contracting parties and any representatives;
- contract amendments
- Claims and counterclaims under the supervision of the Contract Superintendent;
- Contract closure.
Contract Management
In the exercise of his/her responsibilities, the Senior Contract Administrator, under the supervision of the Contract Superintendent, is required to ensure that contracts are executed in compliance with the Endeavour Mining Group's Safety, CSR and Ethics policies, internal procedures and regulations in force in the country of the entity concerned.
- In this capacity, and in coordination with the stakeholders, he/she is required to:
- Ensuring that documentation and exchanges between parties are kept up to date and traceable; Have a good understanding of the need, the operation and/or the project as a whole;
- Ensure that all documents relating to contracts are consistent;
- Assisting the buyer and operational staff in managing project and/or contract risks and implementing mitigation measures, from the signing of the contract through to the end of the implementation phase;
- Participating in the review of specifications and the definition of performance indicators for tender documents;
- Administering and monitoring the proper execution of the parties' actions and contractual obligations under the specifications and associated procedures;
- Manage performance monitoring through progress tracking, quality monitoring and control, action/decision tracking and closure;
- Monitoring and managing non-conformities, deviations, drifts, blockages or risks of disputes and litigation (notification and execution of remedial action plans)
- Anticipating and proposing the implementation of opportunities (e.g. revision of specifications, application of the terms of the contract or proposals for amendments to the contract);
- Administering inspection, testing and acceptance reports (final, single and provisional);
- With the help of the Contract Manger:
➢ Managing contractual warranty claims, notifications and the correct implementation of associated action plans, managing associated costs and planning;
➢ Manage contract closure, where applicable, and draw up the closure report.
Claim Management
The Senior Contract Administrator must help secure the interests of the entity concerned in the management and preparation of claims or counterclaims with a view to developing opportunities for improving financial performance, limiting financial losses, optimising the chances of amicable resolution of disputes and reducing the risk of litigation.
As such, under the supervision of the Contract Manger, he/she will be responsible for:
- Conducting an analysis of the acceptability of the contractual, legal and commercial basis; Participating in the internal management of the preparation of counterclaim and claim files, financial estimates, planning or technical analysis as well as the analysis of Supplier / Service Provider claims in coordination with the (internal) stakeholders;
- With the help of the Contract Superintendent, prepare the claim management strategy (pre litigation) and negotiate out-of-court settlements, where appropriate, and manage the files with a view to minimising the risk of legal disputes.
Other objectives of the position
- To guarantee the correct application of the Group's Contract & Claim Management guidelines within the entity concerned;
- Contribute to the administration of the Group's contract management tool (Source to Contract or S2C) and ensure that the tool is used correctly by the entity's operational staff
SKILLS, KNOWLEDGE & EXPERIENCE
Education:
- 3 years' higher education in Business Law, Business School, Management and Business School, general engineering or equivalent, with multi-disciplinary knowledge of law, project management, purchasing procedures and finance.
Relevant experience:
- To 5 years' industrial experience required, including at least 2 years in the mining sector, with experience in contract or project management preferred;
- Good command of English for negotiation purposes and a good understanding of technical and contractual documentation in English;
- Good operational understanding of the areas of activity of the entity concerned;
- Good coordination, initiative and leadership skills;
- Good capacity for anticipation, analysis, synthesis and rigour;
- Strong ability to convince, resilience and tenacity.
