Position Summary & Responsibilities:

Position Summary:

The Kansas State Board of Indigents’ Defense Services (BIDS) is accepting applications for the position of Deputy Legal Counsel (Public Defender III) in the BIDS Administrative Office in Topeka, Kansas. The Deputy Legal Counsel (DLC) is primarily responsible for the accurate creation, maintenance, revision and tracking of the State Board of Indigents’ Defense Services (BIDS) regulations and policies and ensuring agency compliance. The DLC will monitor changes in legislation and regulations that may impact BIDS and will recommend appropriate courses of action to ensure compliance and mitigate potential risks. Additionally, this position will contribute to BIDS legal strategy, provide comprehensive legal advice to the agency, oversee the preparation and review of complex contracts, agreements, and other legal documents, conduct legal research and stay updated on best practices within the legal field, and represent the agency with regulatory entities and other stakeholders.

Job Responsibilities may include but are not limited to the following:

The Deputy Legal Counsel will fulfill their regulatory responsibilities by engaging with the procedure for adopting new regulations, drafting new regulatory language based on the Board’s votes and guidance from Chief Legal Counsel, shepherding regulations through the adoption process and holding the required public hearing.

Serve as the primary contact for changes to regulations, policies and procedures.
Draft and complete new regulations, policies and procedures with input from the Board, the Executive Director and Chief Legal Counsel.
Thorough and objective legal research and analysis.
Interface with other agencies as needed to complete changes to external policies which impact BIDS.
Fulfil policy duties by drafting new policies, revising existing polices, and implementing policies to mitigate legal risk to the agency, and align with its current operational needs.
This may include, but is not limited to, policies as diverse as Cybersecurity, Human Resources and use of experts by assigned counsel. Once drafted and approved by members of the Administration, these policies must be presented to the Board at an open meeting for adoption.
The Deputy Legal Counsel, with Chief Legal Counsel’s assistance, will also be responsible for contacting and working with outside agencies to make adjustments to their regulations or polices that affect BIDS.
Must maintain an accurate list of current policies, procedures, regulations and the impact on these categories by developing case law, Executive Order or legislative enactment.
This list must also include known requests for changes and those requests that are being acted upon along with their current statuses. Once a change occurs, the Deputy Legal Counsel will be the point-person for the rollout of these new policies and guidance about any changes.

The Deputy Legal Counsel is part of the BIDS Administrative Office’s Legal Division and reports directly to Chief Legal Counsel. The position of Deputy Legal Counsel requires a passionate, persuasive and organized attorney that works equally well with other attorneys and legal staff with or without direct supervision. In addition to their core duties above, Deputy Legal Counsel will assist Chief Legal Counsel and the Assigned Counsel and Expert Coordinator with the work of the Legal Division including, but not limited to: negotiating, drafting and reviewing contracts, reviewing current policies, procedures and relevant law, researching and responding to legal questions, analysis of proposed or recently enacted legislation, and maintaining a positive and productive relationship with experts and assigned counsel. Other tasks within the Legal Division’s responsibility will be assigned as needed. This position will require occasional travel.

Qualifications:

Education and Experience:

Must be a graduate from an ABA accredited law school and a licensed attorney who is active and in good standing in the State of Kansas at the time of employment or is willing to seek Kansas Licensure shortly after employment.
A minimum of 3 years of experience in criminal defense or other comparable legal practice is required.
5 years in criminal defense preferred.

Licensing & Certification:

Maintain licensure as an active attorney in good standing in the State of Kansas.
Must have a valid driver’s license.

Knowledge, Skills, and Abilities:

Must have exceptional written and oral communication skills.
Must have a flexible and solutions-oriented mindset.
Must be a self-starter that does not require significant direct supervision to complete tasks and comply with deadlines.
Ability to use all necessary electronic devices including telephones, computers, e-filing systems, District Court Access Portal, as well as case management systems.
Ability to coordinate with professionals inside and outside of BIDS to assist the agency in providing client-centered, holistic representation.
Must have appropriate time management and organizational skills that help minimize the time required to make necessary changes.
Must generally understand how trial, appellate and post-conviction practice are conducted.
Must be able to handle emergency or crisis situations.
Must be able to handle frequent interruptions and multiple calls and inquiries.
Must be able to effectively interact with clients, co-workers, and other colleagues in a respectful and appropriate manner.
Must be academically curious about criminal law, criminal procedure, law regulating government entities and the creation and deployment of local or systemic changes.
Must be able to treat everyone with dignity and respect without exception.
Must be able to maintain confidentiality and manage confidential information.
Must have a keenly developed and uncompromising set of personal and professional ethics.
Must be able to withstand a moderate noise level in the work environment.
Occasional travel to other work locations outside of the BIDS Administrative office, including various courts, law schools and the Kansas Capitol.
