One of the benefits of an out-state judicial clerkship is the exposure to a multi-faceted caseload, as opposed to working in a single area of the law. In this position, you will address issues in criminal, civil, family, probate, juvenile and conciliation cases. Some matters will be easily addressed, while others quite complex and challenging, but in each instance, you will develop a better understanding of the practical aspects of all litigation. You will have first-hand exposure to the courtroom and see how different attorneys and the Court address issues. You will come to appreciate the demands of our profession in a protected environment with the full support of an experienced judicial team.

Moorhead is located on the Minnesota/North Dakota border. With its sister city of Fargo, ND, the Fargo-Moorhead area is a beautiful, vibrant and growing community of approximately 235,000 residents. The area has all of the advantages of a larger metropolitan area, with three colleges and a robust downtown area, and is home of the Fargo dome, where you can catch a concert, theater production or Bison football game. At the same time, just a short drive outside of Moorhead, you can enjoy some of the most beautiful lakes, state parks, skiing (both downhill and cross country) and mountain bike trails the state has to offer. The community is family and pet friendly. Moorhead will appeal to anyone who is looking to be outside of a very large metropolitan area without sacrificing all the benefits of a big city.

Prior to assuming the bench, Judge Merkins worked as a prosecutor for over 13 years. She is an experienced trial lawyer, who handled all types of cases from serious felonies to child protection, child support and other juvenile cases. Judge Merkins enjoys working with her law clerk on a daily basis, getting input and helping her law clerk understand what is happening both in the courtroom and behind the scenes. She has an emphasis on a collaborative approach with her team to ensure each individual has an active and vital role.

Example of Duties:

Reviews, studies, researches, and annotates laws, court decisions, documents, opinions, briefs, and related legal authorities.
Prepares briefs, legal memoranda, and statement of issues involved, including appropriate suggestions or recommendations to the justice or judge.
Compiles references on laws and decisions necessary for legal determinations.
Confers with justice, judge or court official concerning legal questions, construction of documents and granting of orders.
Attends court sessions to hear oral arguments and records necessary case information; maintain records attendant to court proceedings.
May perform courtroom duties including calling the calendar; swearing injury panels and witness; taking court minutes; and assisting in various court proceedings such as arraignments, motions, hearings, pre-trial conferences and trials.

The caseload involves all types of cases and issues, including: criminal, civil, family, probate, juvenile, and conciliation. The law clerk will work in each of these areas on a regular basis. Anyone with an interest in working in or around the courtroom will enjoy this opportunity.

In addition to traditional duties of research and writing, you will be expected to interact with a variety of stakeholders and participants, manage conciliation court, and develop the skills and knowledge necessary to successfully be a part of a court proceeding. Typical Qualifications:

Juris Doctor (J.D.) degree from an accredited law school.
Strong understanding of general legal principles, state laws, case law, and authoritative legal resources.
Familiarity with court procedures, legal terminology, and judicial practices.
Strong written and verbal communication skills, with the ability to interact effectively with a diverse group of individuals, including attorneys and self-represented litigants.
Proven ability to conduct thorough legal research and analyze complex legal issues.
Professional demeanor with the ability to represent the Court respectfully and appropriately.
Demonstrated ability to build and maintain collaborative working relationships.
Proficiency with Microsoft Office and legal research tools is preferred.
Law Clerks are at-will employees of the Court and work under the direct supervision of a District Court Judge.

Judge Merkin is looking for a person who has both the ability and interest to serve as a successful judicial clerk.

This position will remain open until filled.
Current judicial branch employees must have satisfactory performance in all competencies in their most recent performance evaluation and no discipline above an oral reprimand in the preceding 6 months.

Full State of Minnesota Benefit package. District court law clerks will be placed within the pay range based upon post law school graduation legal work experience.
