About the Role
We are hiring an experienced Workers’ Compensation & Liability Attorney to join our direct client’s legal team. This is a remote role requiring a Virginia Bar license and prior experience handling Workers’ Compensation and Liability litigation. The ideal candidate will be responsible for managing a diverse caseload, providing strategic legal counsel, and advocating for clients in litigation matters.
Key Responsibilities
Case Management & Litigation:
Handle all aspects of Workers’ Compensation and Liability defense litigation, including case evaluation, strategy development, and resolution.
Represent clients in court hearings, mediations, depositions, and administrative proceedings before the Virginia Workers’ Compensation Commission.
Conduct legal research and draft motions, pleadings, briefs, and other legal documents.
Defend employers and insurance carriers against Workers’ Compensation claims and general liability matters.
Develop and implement litigation strategies tailored to each case.
Client Advisory & Communication:
Provide legal counsel to clients, insurance carriers, and employers on Workers’ Compensation laws, liability claims, risk mitigation, and compliance.
Maintain regular communication with clients, offering updates, legal strategies, and risk assessments.
Collaborate with medical experts, investigators, and vocational rehabilitation specialists for case development.
Negotiations & Settlements:
Negotiate settlements and engage in alternative dispute resolution when appropriate.
Participate in mediation and arbitration proceedings, advocating for favorable outcomes.
Compliance & Risk Management:
Ensure cases comply with Virginia Workers’ Compensation laws and regulations.
Stay updated on changes in legal statutes and precedents affecting Workers’ Compensation and Liability cases.
Provide training and legal updates to corporate clients and insurance partners as needed.
Key Qualifications
Must have an active Virginia Bar license.
3+ years of experience in Workers’ Compensation defense and Liability litigation.
Strong litigation and trial experience, including handling depositions and motions.
Excellent legal research, writing, and negotiation skills.
Ability to work independently in a remote setting while maintaining effective communication with the legal team and clients.
Strong organizational skills with the ability to manage multiple cases simultaneously.
Proficiency with case management software and legal research tools.
Additional Preferred Qualifications
Experience with insurance defense, personal injury litigation, or employment law is a plus.
Familiarity with civil litigation procedures in Virginia courts.
Ability to work across multiple jurisdictions (additional state Bar admissions are a plus).
