The Office of the Clerk of Superior Court, Yadkin County, seeks an individual to serve in the position of Deputy Clerk, Criminal Division, in the legal system of North Carolina. Criminal Deputy Clerks perform specialized clerical and administrative work in a Clerk of Superior Court office that involves processing criminal cases. In the largest offices work may involve processing only one phase of a criminal case such as the initial filing, continuances or judgments for one or more areas of criminal district court cases (misdemeanors, infractions, and appeals from magistrate court), or superior court cases (felonies or appeals from district court). In the smallest offices work may involve processing all phases and areas of criminal cases. Work involves providing information to the public, attorneys, law enforcement, and others on criminal forms and procedures, establishing and maintaining hard copy and electronic files, and reviewing and processing documents related to assigned cases.
As a Criminal Deputy Clerk, you may perform a variety of duties such as, but not limited to, the following:
Filings
Discuss and explain court rules and procedures to attorneys, the public and others by phone or in person.
Listen and ask probing questions to determine the appropriate course of action; redirects to other departments as appropriate.
Identify and provide applicable forms and written instructions without providing recommendations as to any specific course of action.
Dispositions
Dispose of cases in Enterprise Justice/CourtFlow; prepare probation judgments and commitments; continues cases in Enterprise Justice; issues subpoenas; enter called and failed dates; process bond forfeitures; issue Orders for Failure to Appear (OFA) in eCourts, etc.
Process expunctions, orders for arrest, court-ordered bond forfeitures, fee applications, court continuances, record check requests, Civil Revocations (CVR), petitions for vehicle seizures, search warrants, extraditions, etc.
Audit various criminal reports; process as appropriate; prepares and sends notices to applicable parties.
Miscellaneous Responsibilities
Assist public, attorneys and others in conducting research of public files by pulling and re-filing case files, providing information on procedures while not offering legal advice, and making copies or assigning customers a copy-key (HECON) to make copies themselves, if requested.
File new and disposed criminal cases.
Prepare files for destruction in accordance with rules of recordkeeping.
Calendar cases for district and superior court.
New hires may be paid above the minimum rate depending on education and experience in a North Carolina Clerk of Superior Court office.
Knowledge, Skills and Abilities / Competencies
Knowledge of: NC general statutes; policies and procedures related to criminal proceedings; local judicial district procedures; Enterprise Justice; basic math; and general office/clerical procedures.
Skills in: active listening; communicating both verbally and in writing; and MS Word, Excel, and Outlook.
Ability to: read and comprehend legal documents; interact diplomatically with a diverse group of people; empathize; adjust to unexpected events while meeting deadlines; organize, carry and manage files, shucks; work independently; and provide procedural information without giving legal advice.
Minimum Education and Experience Requirements
High school diploma or equivalent. Minimum of 18 years of age. Yadkin County residents preferred.
Management prefers applicants with professional experience working in a courthouse or law office.
