We are seeking an Assistant County Attorney to join our legal team in Henderson County, Kentucky. The Henderson County Attorney’s Office touches the life of virtually every citizen of Henderson County. Among various other duties, we prosecute all violations of criminal law within District Court, including DUIs, domestic violence, cold checks, juvenile crime, and we conduct preliminary hearings on all felony cases. The office is also involved in dependency, neglect & abuse proceedings in Henderson Family Court; guardianship proceedings; and, Casey’s Law proceedings.
Position Summary:
The Assistant County Attorney is primarily responsible for representing the government in criminal cases, presenting evidence, and ensuring that justice is served in accordance with the law. The role involves reviewing evidence, preparing legal documents, and conducting trials or hearings. The prosecutor will work closely with law enforcement agencies, victims, witnesses, and other stakeholders to prosecute criminal cases involving violations, misdemeanors, and felonies. The responsibilities may also include prosecuting juvenile court cases in District Court and/or Dependency, Neglect & Abuse cases in Family Court and handling Guardianship and Casey’s Law pretrials and trials on behalf of the County Attorney’s Office.
Minimum Requirements
Education: Must be admitted to practice law and in good standing in the Commonwealth of Kentucky or have the ability to obtain admission via SCR 2.111 (Limited Certificate of Admission), SCR 2.112 (Limited Admission for County Attorney Offices), SCR 2.116 (Supervised Practice), and/or SCR 2.117 (Practice Pending Admission). Must maintain any required licensures, certifications, or other credentials for the length of employment in this classification.
Experience, Training or Skills: Experience handling criminal law cases is preferred, but not required. Applicable prosecutorial training is available and required after date of hire. The applicant shall have, at minimum, the following competencies: self-motivation, problem solving, multi-tasking, time management, professionalism, integrity, detail-oriented, superior communication, teamwork, attendance/punctuality, listening, computer proficiency, ability to learn and adapt to new concepts/programs in a timely fashion.
Other: Must be able to pass criminal background check. All hires are subject to approval by the Kentucky Prosecutors Advisory Council.
Specific Duties & Responsibilities:
At all times maintain a commitment to the highest standard of legal ethics and a commitment to justice.
Represent the Commonwealth of Kentucky during pretrial hearings, arraignments, trials and post-conviction matters.
Confer with victims of crime and protect victims’ rights in compliance with Marsy’s Law.
Oversee cases in various phases of litigation.
Perform legal research.
Prepare and file legal documents including complaints, motions, and other necessary court filings.
Carry out negotiations with defense counsel and pro-se defendants.
Prepare and argue cases from arraignment through trial.
Review and handle appeals from District or Circuit Court, as necessary.
Attend court, applicable training sessions, and meetings in a timely manner.
Remain updated on changes to applicable case law, statutes, and ordinances.
May work as a member of an inter-disciplinary team.
May coordinate the efforts of non-attorney staff.
May be assigned to assist or collaborate with other attorneys within our office on cases, research projects, developing training materials regarding legal updates, or other job-related matters.
Perform other duties as assigned.
Comply with PAC and Henderson County Attorney’s Office Personnel Policies and Procedures.
Typical Working Conditions
The Assistant County Attorney position is within our Criminal Prosecution Division – which includes six other attorneys, one administrative assistant and a victims’ advocate. This position is a full-time position with a minimum of forty (40) hours per week and is typically from 8:00 a.m. to 5:00 p.m., Monday through Fridays. There are circumstances that occasionally require an employee to work beyond the typical work hours.
After requisite training, the Assistant County Attorney would be on call to assist law enforcement with preparing search warrants or arrest warrants after normal working hours – which is scheduled on a rotating basis with all the other attorneys in the Criminal Prosecution Division.
Duties are primarily performed in both office and courtroom settings. Travel is required for applicable yearly training events.
Salary and Classifications
The salary for this position is currently $63,000.00 per year for an entry-level prosecutor/attorney (Assistant County Attorney I). This position is funded by the Kentucky Prosecutor’s Advisory Council (PAC). In 2024, the Prosecutors Advisory Council (PAC) adopted a classification and pay scale for PAC staff in the County Attorney’s Office. The minimum salary for a full-time Assistant County Attorney I is $63,000 per year and increases to a minimum of $106,200 per year for an Assistant County Attorney IV. If the successful applicant has previous experience through the Prosecutors Advisory Council and/or Department of Public Advocacy, the position may be reclassified as an Assistant County Attorney II, III or IV, subject to PAC review/approval and availability of PAC funding.
