Statement
The Delaware Department of Justice is seeking an exceptional and highly motivated individual to join the Forfeiture Unit within the Criminal Division as a Legal Assistant (Paralegal). The Forfeiture Unit has statewide responsibility, but this limited‑term position will be located in New Castle County for a duration of two (2) years.
This Legal Assistant will provide support to Deputy Attorneys General by reviewing Title 16 seizures, tracking forfeiture cases and related criminal cases from intake through final disposition, preparing case files, discovery, motions, pleadings, subpoenas, and notification letters. The assistant will assist attorneys in court hearings, maintain court schedules, record statistics required by HB280, and review police, medical, retail, surveillance and electronic documents to summarize pertinent details.
Additional responsibilities include assisting with Title 11 seizures and the SLEAF process.
Essential Functions
- Act as liaison between superiors and parties such as clients, defendants, plaintiffs, victims, witnesses, law enforcement, elected officials and the public to gather, clarify and provide information regarding case facts and status.
- Establish and maintain complete and accurate case files from pre‑hearing through trial and sentencing.
- Interview parties and gather discovery material and evidence for case preparation.
- Review reports and documents, summarize case details, follow up for additional records, draft answers to complaints, responses to interrogatories, issue subpoenas, prepare and serve discovery, and redact documents as needed.
- Research case law, statutes, codes and regulations to ensure proper citation and provide written analyses of similar cases.
- Prepare legal pleadings, including briefs, motions, indictments and appeals.
- Provide reports and recommendations for new or revised operating policies and procedures.
- Ensure compliance of legal actions and processes with applicable state and federal codes, laws, rules and regulations.
Job Requirements – Level I
- Three years of employment with the Department of Justice in a similar capacity; or
- Associate degree or certificate in Paralegal Studies from an ABA‑approved program; or
- Bachelor’s degree in criminal justice or a related field; or
- Three years’ experience in preparing and maintaining legal documents and case files; or
- Three years’ experience in legal research such as researching statutes, regulations, case law and background information; or
- Three years’ experience in interpreting laws, rules, regulations, standards and policies; or
- Two years’ experience drafting legal briefs or memoranda of law; or
- Two years’ experience interviewing using structured or unstructured techniques.
Job Requirements – Level II
- Five years of employment with the Department of Justice in a similar capacity; or
- Associate degree or certificate in Paralegal Studies from an ABA‑approved program; or
- Two years’ experience preparing and maintaining legal documents and case files; or
- Two years’ experience in legal research; or
- Two years’ experience interpreting laws, rules and regulations; or
- Two years’ experience drafting legal brief or memorandum of law; or
- Two years’ experience interviewing; or
- Bachelor’s degree in criminal justice or a related field; or
- One year of experience preparing and maintaining legal documents; or
- One year experience in legal research; or
- One year experience in interpreting laws, rules and regulations; or
- One year experience drafting legal documents; or
