Responsibilities
- Provide legal subject matter expertise to support the Legal & Professional Services Lead, the Civil Family & Tribunals Head of Legal Operations and MoJ policy teams, aiding in drafting and introducing legislation affecting Magistrates’ and Crown Courts.
- Conduct research and offer specialist advice to support ministerial correspondence and oral questions during legislative passage.
- Maintain and update digital knowledge resources, ensuring Legal Advisers have timely access to accurate, current information.
- Contribute to the implementation of the government’s legislative agenda, assisting national working groups, drafting statutory guidance materials, and creating operational processes and guidance for HMCTS staff.
- Plan and support the implementation of legislative and procedural change, monitoring performance and legal compliance to ensure effectiveness.
- Design and build legal business solutions and advise on best practice and compliance.
- Facilitate feedback loops on sentencing guidelines and contribute to accurate implementation.
- Build and sustain productive relationships with Judicial College, HMCTS, Justice Partners, Judicial Office, and other stakeholders to coordinate legislative impact and implementation.
- Investigate and propose solutions to issues affecting the provision of legal services, assessing practical implications and risks.
- Provide clear, decisive legal advice in drafting guidance and responding to queries from HMCTS colleagues and other justice partner agencies.
- Support business planning, prioritise workloads, and initiate corrective actions to meet business and operational needs.
Qualifications
- Professionally qualified solicitor, barrister or CILEx professional with extensive experience as a magistrates’ courts legal adviser.
- Current, in‑depth knowledge of law affecting Magistrates’ Courts jurisdictions, including legislation, rules, practice directions and case law.
- Strong understanding of Magistrates’ Court operational processes, legal procedures and administrative functions.
- Exceptional attention to detail and ability to read and interpret complex legislation accurately.
- Proficiency in drafting clear, concise legal guidance that is easily understood by legal and administrative staff.
- Ability to plan, organise and manage multiple projects across varying time‑frames, prioritising to meet business objectives.
- Capacity to manage own time and workload independently.
- Desirable: recent experience in family jurisdiction.
