Position Functions
Participation in the implementation of the market compliance system (competition protection, REMIT, EMIR, MIFID II, FinFrag, etc.).
Participation in planning, management and implementation of a regulatory compliance system to comply with national legislation in the countries of presence;
Development and implementation of processes aimed at meeting regulatory/antitrust requirements;
Development of internal regulatory documents in the field of compliance;
Analysis/assessment of the company’s activities for compliance with regulatory/antitrust requirements, identification of risks and their mitigation;
Conducting research on the functioning of wholesale energy markets in Ukraine/EU/Switzerland;
Analysis and preparation of proposals for draft laws, draft resolutions of the National Commission for the Regulation of the Ukrainian Energy and Utilities Commission, the Antimonopoly Committee of Ukraine, and the National Securities and Markets Commission;
Support for licensing/registration procedures for trading activities of group companies in Ukraine and foreign jurisdictions;
Advising the group’s divisions on legal issues within the company’s operational activities, including licensing issues, regulatory obligations in Ukraine and foreign jurisdictions, REMIT/EMIR/MIFIDII.
Ensuring monitoring of changes in regulatory/antitrust requirements in the countries of presence;
Analysis of relevant judicial and administrative law enforcement practice in the areas of energy and antitrust legislation, etc.
Education/Qualifications
Advanced level of English (oral and written required) ;
Experience in preparing internal documents (policies, procedures, instructions, other internal documents), including documents in English;
Basic understanding of trading processes in the energy products/financial instruments/derivatives market.
Knowledge of the provisions of the legislation of Ukraine on the functioning of the electricity and natural gas market (Law of Ukraine “On the Electricity Market”, Law of Ukraine “On the Natural Gas Market”, Market Rules (electricity), Day-Ahead and Intraday Market Rules, Transmission System and Distribution System Codes), the Law of Ukraine “On Capital Markets and Organized Commodity Markets”, antitrust legislation is an advantage;
Ability to analyze and apply the norms of national and foreign law, international agreements, and trade customs;
Experience in interacting with the National Securities and Markets Commission, National Regulatory Commission for Economic and Monetary Affairs, and Antimonopoly Committee of Ukraine is an advantage;
Experience in interacting with relevant international organizations (ACER, ESMA, FINMA, Energy Community) is an advantage;
Experience in participating in the development of draft laws in the field of energy and competition law is an advantage;
Experience working in law firms in compliance/energy law/competition law practices or international energy companies is an advantage;
Knowledge of the requirements and procedures of EU and Swiss regulations on the monitoring and control of commodity and financial markets (REMIT, EMIR, MIFID II/MIFIR, FinfraG, FMIA, FinSA) is an advantage/
