The Alcoholic Beverage Control Division administers the New Mexico Liquor Control Act and the Tobacco Products Act. The Division is responsible for liquor and tobacco products licensure, compliance, permits for special events and festivals, server training certification, server training provider approval, prosecution of administrative violations of the Liquor Control Act and Tobacco Products Act by establishments and servers and other support functions. New Mexico is one of 32 states classified as a licensure state, where the alcoholic beverage industry is a private enterprise licensed and regulated by the state and is one of 12 states to require mandatory alcohol server training. New Mexico operates within a three-tiered system for alcohol and tobacco products distribution, meaning that alcohol and tobacco products are sold from the manufacturer to a wholesaler and then to a retailer. Currently, there are approximately 4,900 liquor establishment licenses in thirty-four different categories, approximately 1,600 tobacco licenses and approximately 67,000 active certified alcohol servers.
Why does the job exist?

The purpose of this position is to protect public health and safety by ensuring that businesses are complying with the Tobacco Products Act – becoming licensed for retail sales, distribution and manufacture of tobacco products as required by statute. This incumbent will work with the Department of Public Safety, Special Investigations Unit and local law enforcement regarding any violations of the Tobacco Products Act. The incumbent will conduct site inspections of businesses, provide information about the licensing process and in conjunction with DPS/SIU, issue administrative citations for violations.
How does it get done?

Conduct field inspections of businesses in New Mexico that conduct retail sales, distribution and manufacture of tobacco products. Proactively work with business owners, providing them with applications and information on how to become licensed if they are not. Work with law enforcement to cite businesses, administratively or criminally, that will not comply or for those who sell tobacco products to minors.
Assist Attorney with prosecution of citations issued for tobacco violations. Conduct investigations, assist with case preparation, and testifying at any hearings.
Assist with review of license applications, renewal of tobacco licenses and assisting applicants with questions. Ensure that applications are complete, applicants and locations meet statutory requirements and ensure that all fees are collected in compliance with state law.
Assist with miscellaneous duties as assigned.

Our customers are alcohol servers, alcohol and tobacco license holders, product manufacturers, wholesalers, and the public. They are business people, attorneys, law enforcement, lawmakers and each citizen impacted by liquor and tobacco products.

Minimum Qualification

High School Diploma or Equivalency and two (2) years of experience in investigations, regulation, policy, statutory, and/or contract compliance. Any combination of education from an accredited college or university in a related field and/or direct experience in this occupation totaling two (2) years may substitute for the required experience.
Employment Requirements

Incumbent must possess and maintain valid Driver’s License, currently possess or be eligible to obtain a Defensive Driving Certificate and successfully pass a Background Investigation. This position does not require supervision of employees.
Working Conditions

The incumbent works in an office environment and in the field. There is frequent driving, use of computers, printers, scanners and telephones. The applicant must be able to lift up to 50 lbs. There will be frequent travel around the state, so the incumbent must have a valid driver’s license.
