Our client is looking to hire a Head of Legal and Regulatory to lead its Australian legal function.

Reporting directly to the CEO, this role will be responsible for overseeing the legal, regulatory, and compliance side of our client’s business in Australia.

Key responsibilities

The Head of Legal and Regulatory will be responsible for leading and growing the legal function and will be a key member of the company’s senior leadership team, providing legal and strategic guidance to the Australian business unit of an international group.

This is a greenfield role and the new Head of Legal and Regulatory must be comfortable establishing a new function and developing new processes and policies in line with best practice to achieve organisational objectives and ensure the efficient and effective delivery of legal services.

The key responsibilities for this role include:

Advising the CEO and Board on legal and regulatory matters relating to the company’s Australian operations

Taking the lead on complex negotiations with various partners, governmental authorities, and industry bodies

Playing a central role in the management of the relationship with the company’s joint venture partner and other key external stakeholders

Ensuring compliance with the company’s legal and regulatory obligations, including with respect to Australian environmental standards

Identifying opportunities for the business and providing guidance to enable the company to derive maximum benefit

Improving internal processes in relation to contracting, procurement, and risk management to increase operational efficiency and mitigate risk

Manage disputes with third parties and provide strategic advice to protect the Resource Owner’s commercial interests and reputation

Select and manage relationships with external counsel

Implement and oversee corporate governance frameworks and initiatives in line with industry best practices

Perform and/ or manage the company secretarial function

Ensure that the company has appropriate WHS policies and procedures to protect our workforce

Leading the ESG team, encompassing sustainability, decarbonisation, stakeholder engagement and diversity and inclusion

Build and mentor a first-class legal function that engages with the business and raises the level of knowledge of all team members, teaching them how to most effectively engage with the legal function

Essential criteria

Qualifications and experience

Law degree and admission to practice in an Australian jurisdiction with a current, unrestricted practicing certificate (or eligibility to apply for oneimmediately)

Minimum of 10 years’ post-admission experience within the mining and resources sector gained in a leading law firm and/ or in-house legal team

Personal attributes

Exceptional communication skills and the ability to engage effectively at all levels

Leadership skills and the ability to manage and influence stakeholders

Strong commercial and financial acumen

Desirable criteria

While experience in a greenfield General Counsel role would be seen favorably, this opportunity would also be perfect for a senior lawyer looking to take the next step in their career

Formal corporate governance, risk management, and company secretarial qualifications will be highly regarded

Listed entity experience will be highly valued
