Firm Overview
We are an established New York law firm representing medical providers within the state’s No-Fault insurance system. A significant portion of the firm’s practice involves defending healthcare providers in federal court against Civil RICO and common-law fraud actions brought by insurance carriers, primarily in the Eastern District of New York.
Position Summary
The firm seeks a full-time federal litigation attorney with trial experience to manage a caseload of Civil RICO and fraud defense matters from inception through resolution. Although the subject matter involves No-Fault insurance, the core of the position is federal litigation; prior No-Fault experience is preferable but not required. The attorney will be responsible for case strategy, dispositive motion practice, discovery, court appearances, and trial participation, and will work directly with the firm’s partners.
Responsibilities
– Manage a caseload of federal litigation matters, primarily the defense of Civil RICO and fraud claims against healthcare providers
– Develop and execute case strategy, including initial case analysis, risk assessment, and trial planning
– Draft federal pleadings, dispositive motions (motions to dismiss, motions for summary judgment), motions in limine, and discovery requests and responses
– Manage all phases of federal discovery, including e-discovery protocols and taking and defending fact and expert depositions
– Appear at status conferences, motion arguments, and pre-trial conferences, and participate in trial proceedings, both virtually and in person
– Conduct legal research using Westlaw, PACER, and related resources
– Conduct settlement negotiations and appear at mediations
– Coordinate with partners, associates, support staff, and clients
Required Qualifications
– Juris Doctor (J.D.) from an accredited law school
– Admission to the New York State Bar; active and in good standing
– Admission to the U.S. District Court for the Eastern District of New York (EDNY) required; SDNY admission a plus
– Minimum three (3) years of substantive federal litigation experience
– Significant experience drafting federal motions and pleadings
– Experience managing the federal discovery process
– Experience appearing as counsel of record in federal court proceedings
– First- or second-chair trial experience (state or federal)
– Proficiency with legal research platforms (Westlaw, PACER)
– Strong analytical, writing, and oral advocacy skills
– Ability to work independently and manage deadlines on complex matters
Preferred Qualifications
– Direct experience litigating Civil RICO and/or complex fraud claims (strongly preferred)
– Experience representing healthcare providers
– Experience with New York No-Fault insurance law
– First-chair trial experience in federal court
– Personal injury or workers’ compensation litigation experience
