Title: Executive Breach of Contract

This role resides under MISC Marine (the Integrated Marine Services arm of MISC Group).
Key Accountabilities
1. Agreement & Contract Management
- Administer and maintain records for all training, scholarship, cadetship, and bond agreements.
- Ensure agreements are properly executed, stored, and retrievable for audit or legal purposes.
- Monitor contractual service periods, milestones, and expiry dates.
2. Breach Identification & Assessment
- Identify cases of breach of training or cadetship agreements, including:
- Early resignation
- Failure to complete training
- Non‑compliance with service obligations
- Assess breach cases in accordance with contract terms, company policy, and applicable labour laws.
3. Recovery & Compensation Management
- Calculate bond recovery amounts, liquidated damages, or compensation due.
- Prepare official demand letters, notices of breach, and repayment schedules.
- Coordinate recovery actions such as:
- Salary offsets
- Instalment arrangements
- Full settlement negotiations
4. Stakeholder & Legal Liaison
- Liaise with:
- Cadet/ trainees defaulter
- Guarantor
- Legal advisers
- Finance / payroll teams
- Training departments
- Training Institution
- External agencies or law firms (if escalation is required)
- Provide case documentation, record analysist and support for legal proceedings or mediation, when necessary.
5. Policy Compliance & Risk Control
- Ensure all actions comply with:
- Cadetship Agreement/ Agreement (s)
- Company handbook
- Employment contracts
- MLC
- Malaysian labour and contract laws
- Internal governance and audit requirements
- Highlight contractual risks or loopholes and recommend policy or agreement improvements.
6. Reporting & Documentation
- Prepare management reports on:
- Breach cases
- Recovery status
- Financial exposure and trends
- Maintain accurate case files, correspondence logs, and settlement records.
7. Advisory & Preventive Support
- Provide advisory support to HR and Training on:
- Contract wording
- Bond structures
- Employee communication strategies
- Assist in briefings or briefings to cadets/trainees on contractual obligations and consequences of breach.
Job Requirements
Education
- Bachelor’s Degree in: Human Resource Management, Business Administration, Law, Marine related discipline
Experience
- Minimum 2–5 years in:
- Contract / Bond management
- Training administration
- HR operations
- Contract administration
- Legal or compliance‑related roles
- Experience handling employment contracts or bonded training programs is a strong advantage.
Skills & Competencies
- Strong understanding of employment and contract principles
- High attention to detail and accuracy
- Strong written and verbal communication skills
- Conflict handling and negotiation skills
- Ability to manage sensitive and confidential matters professionally
- Proficient in MS Excel, Word, and HR systems
- Marine / Sea background (preferred)
