Assistant Prosecuting Attorney – Civil Division
HOURS: Monday – Friday, 8:00 a.m. – 4:00 p.m.
STARTING SALARY: $86,320.00; salary commensurate w/level of experience
FLSA: Exempt
Job Overview: The Hamilton County Prosecuting Attorney is seeking to fill two positions as an Assistant Prosecuting Attorney (APA): (1) an attorney to handle Litigation matters; (2) an attorney to handle Transactional matters, including real estate matters. Both the Litigation attorney and the Transactional attorney shall have a firm foundation in legal research and writing and good time-management skills.
The Litigation APA will participate in all levels of pre-litigation and actual litigation in court and before administrative agencies. The Litigation APA will represent all Hamilton County elected officials, Hamilton County offices, and Hamilton County officers and Hamilton County employees who are sued in their official capacities. The litigation APA will research and write legal opinions to County officers and other clients of the Prosecuting Attorney.
The Transactional APA will review and write contracts involving all levels of County government and all offices of County government, specifically including real estate contracts. The transactional APA will research and write legal opinions to County officers and other clients of the Prosecuting Attorney.
Responsibilities and Duties:
LITIGATION APA – 10+ years of experience
Analyze legal issues; Conduct legal research on various legal issues.
Review and prepare discovery requests and draft discovery requests to the opposing parties.
Prepare motions and legal briefs and conduct depositions.
Handle Trial Court litigation including appeal procedures.
Work professionally with opposing counsel, court personnel, law enforcement agencies, and the public.
Perform all other duties assigned, delegated or required by supervisor or the Prosecuting Attorney as well as those prescribed by law.
TRANSACTIONAL APA – 5+ years of experience
Review contracts of County offices including revisions and preparation of original contracts on behalf of County offices.
Analyze legal issues; Conduct legal research for opinions of the Prosecuting Attorney.
Prepare and finalize opinions of the Prosecuting Attorney for the signature of the Prosecuting Attorney.
Preform all other duties assigned, delegated or required by supervisor or the Prosecuting Attorney as well as those prescribed by law.
Qualifications:
Bachelor’s Degree
Juris Doctorate
Admission to Ohio Bar pursuant to Section 4705.01 of the Ohio Revised Code
Critical thinking and decision-making skills
Detail oriented
Flexible and quick-thinking
Quick learning ability when new tasks are required
Prioritize all job duties to ensure accurate and timely completion of responsibilities
Good time management
Possess excellent research and writing skills with requisite understanding of relevant legal issues
Knowledge of computers and computer operating systems with ability to learn Matrix case management system; knowledge of LexisNexis Legal Research product
Must possess qualities of fairness, a strong work ethic, have the highest integrity
Maintain confidentiality
Able to conduct business in accordance with federal statutes and guidelines and the Ohio Revised Code
Able to perform all other duties assigned, delegate or required of an Assistant Prosecuting Attorney as well as those prescribed by law.
