Position Level: Section Head or equivalent to Supervisor

What “Termination and Litigation” will do

Daily Operation Management:

Manage overall operations of subordinates in litigation team, ensuring smooth operations.

Manage administrative works including issuing warning letters and clarification letters to government entities and customers, as required.

Legal Issue Management:

Manage legal issues, daily operations including the litigation process, Control NCB data submission, ensuring accuracy and compliance.

Provide legal comments and correspondences as needed, particularly in cases involving customers and government sectors.

Outsourced Agency and Vendor Management:

Manage and control the operation of the legal vendors/outsourced agencies, ensuring their adherence to established standards and protocols.

Coordinate with outsourced litigation offices and monitor the progress of outsourced litigations.

Occasionally visit outsourced agencies and legal vendors to ensure effective collaboration and performance.

Litigation Handling:

Conduct and prosecute civil, criminal, bankruptcy, business rehabilitation cases in the court.

Prepare and maintain reports on cash recovery, court cases, court cancellations, and vehicle repossessions following termination.

Enforcement and Auction Management:

Handle and prosecute enforcement, execution, and cars auction in according with civil court judgement.

Manage and supervise repossessions and auction sales of defaulted assets.

Contract Termination Management:

Manage the team to maintain / record the accurate payment status of terminated contracts and propose proper solutions to address related issues.

Qualification Requirements

Bachelor’s or Master’s degree in Law

Strong knowledge in Hire-Purchase business especially in Debt Collection, Vehicle Repossession, Litigation, NCB data submission and Enforcement fields. (Direct experience in loan, hire purchase leasing industries are advantageous)

Proficiency in Announcements of Contract Committee, Debt Collection Act, AML/CFT and PDPA

Strong planning and organization skills

Strong presentation skills with highly technical matter

Creative and confident in designing and implementing impactful litigation strategies

Proactive and highly organized, capable of managing multiple priorities within strict deadlines

Strong problem-solving skills for handling imperfect and ambiguous information

Good command of English and Computer Literacy, Excellent interpersonal skills, with the ability to work well with a wide variety of stakeholders.
