Position Overview
Mecartea and Associates LLP is seeking a dedicated and experienced Managing Attorney to oversee and ensure proper supervision of nonlawyer staff in accordance with professional and ethical obligations, including Rule 5.3 of the ABA Model Rules of Professional Conduct (formerly Rule 39). The Managing Attorney will play a key leadership role in ensuring that all nonlawyer personnel—such as paralegals, legal assistants, intake staff, and administrative personnel—perform their duties in full compliance with the firm’s standards and applicable legal and ethical rules.
Key Responsibilities
Supervision & Oversight
Directly supervise nonlawyer employees to ensure that their conduct is compatible with the professional obligations of the firm and its attorneys.
Develop and enforce policies and procedures governing the work of nonlawyer staff.
Provide regular training and guidance to ensure ethical, competent, and professional service delivery.
Compliance & Ethics
Maintain firm compliance with Rule 5.3 regarding responsibilities of a lawyer over nonlawyer assistance.
Monitor workflows, communications, and output to ensure unauthorized practice of law (UPL) does not occur.
Promptly identify and resolve any compliance or ethical issues that arise in the course of work.
Case Management & Delegation
Assign legal support tasks appropriately to nonlawyer personnel while retaining full responsibility for legal judgment and decision-making.
Review and approve any work product prepared by nonlawyer staff before submission or use in legal proceedings.
Team Leadership
Support recruitment, onboarding, and professional development of nonlawyer staff.
Promote a respectful, inclusive, and professional work culture aligned with the firm’s values and mission.
Qualifications
Juris Doctor (JD) from an accredited law school and active license to practice law in [insert applicable state(s)]
Minimum of 5 years’ legal experience, with at least 2 years in a supervisory or leadership capacity
Strong understanding of attorney professional responsibility rules, including Rule 5.3
Exceptional communication, organizational, and leadership skills
Commitment to ethical legal practice, client service, and mentorship
