Description
:
This course introduces students to the structure, functioning and underpinning principles of the Canadian legal system. The first half of the course serves as an introduction to public law, including: sources of law; the federal legislative process and statutory interpretation; the legal system’s constitutional basis, an introduction to Indigenous laws and legal orders; the organization of courts and tribunals in Canada and appeal processes;
and the role of the courts in overseeing legislative and administrative action. The second half of the course surveys the advent of the Canadian Charter of Rights and Freedoms; the framework of the Charter; an introduction to the fundamental rights and freedoms protected by the Charter; and an introduction to constitutional remedies. CML 1206 is offered in a small-group format in which students also learn skills associated with legal reasoning, research and writing.

Requirements:
The Common Law Section is seeking candidates who are leaders in the legal profession. An LL.B. or, J.D. from a Canadian law school, or equivalent is required for this position. Membership in the Law Society of Ontario, or equivalent, in good standing is an asset. The successful candidate will have significant experience in the areas of public and constitutional law, including institutions of law-making, adjudication and administration, as well as the Charter.
The successful candidate will also have significant experience in teaching legal reasoning, writing and research. Prior teaching experience will be considered an asset.
The Common Law Section reserves the right to select a candidate who does not fully meet each of these requirements, where the candidate’s selection would be beneficial to the program, the course, the students or for a related reason.
Additional Information and/or Comments:
This course runs through both the fall and winter sessions and candidates will be required to teach as per the schedule in both sessions.
An acceptable level of education and/or experience could be viewed as being equivalent to the educational required and/or demonstrated experience.
